Legal Analysis of Annual Leave Pay
Assuming the employment offer originates from a Dubai-based mainland company, the provisions of the UAE Federal Decree Law No. 33 of 2021 regarding the Regulation of Employment Relations apply. Under Article 29(1)(a) of this law, employees are entitled to 30 days of paid annual leave for every year of completed service.
The critical factor is the definition of “wage” provided in Article 1 of the Employment Law. The law defines the wage as the basic salary plus any additional allowances, whether provided in cash or as a benefit in kind, as specified in the employment contract or company bylaws.
