The Bombay High Court has issued a severe reprimand to actor Imran Khan following his participation in a political demonstration in Mumbai, citing violations of foreign citizenship and Overseas Citizen of India (OCI) card regulations. The court firmly established that individuals holding OCI status are strictly prohibited from engaging in any form of political protest or agitation while residing in India.
Background of the Legal Dispute
The controversy emerged last month when the actor took part in a protest organized by the ‘Cockroach Janata Party’ (CJP) in Mumbai, which demanded the resignation of Chief Election Commissioner Gyanesh Kumar. Following his participation, authorities issued a notice requiring the actor to leave the country by October 28. Khan subsequently challenged this departure notice by filing a petition in the High Court.
Court Mandates and Interim Relief
- During the hearing held on November 2, the court extended the actor’s interim protection until December 7.
- The bench explicitly ordered Khan to submit a formal, unconditional apology for his actions.
- The court emphasized that a standard affidavit would be insufficient; he must clearly express his remorse to the satisfaction of the judiciary.
The bench delivered sharp observations during the session, remarking, “If any Indian citizen went abroad and did something like this, they would be put on the next flight back to India immediately.” The judges further questioned the actor’s sudden involvement in local politics, noting his long history of living in India without prior participation in such agitations. “Go to the United States and protest there, you can even vote there; but we will not tolerate such demonstrations here,” the court added.
Arguments and Personal Defense
Representing the Foreigners Regional Registration Office (FRRO), the Solicitor General argued that as an American citizen and OCI cardholder, Khan’s rights and privileges are distinct from those of a full Indian citizen. The counsel highlighted that Khan wields significant public influence through his popularity on platforms like Instagram, suggesting he understood the nature and objectives of the protest before attending. In response, Khan emphasized his deep-rooted connection to the country, explaining that except for a two-year period in America, he has spent his entire life in India. He asserted that India is his true home, noting that his professional career, personal life, and children are all anchored in the country.
Judicial Perspective on Citizenship
Despite the strict stance, the court invoked the philosophy of ‘Vasudhaiva Kutumbakam’ (the world is one family). The judges expressed hope that in the future, authorities might exercise enough generosity to allow the actor to continue residing in India, acknowledging the complexity of his situation as a long-term resident with foreign citizenship.
