One year after the death of actor Malcolm-Jamal Warner, his widow, Tenisha Warner, has initiated legal action against his mother, Pamela Warner. The lawsuit, filed Monday in the DeKalb County Superior Court in Decatur, Georgia, seeks more than $1.2 million in funds that Tenisha Warner claims are owed to her under the terms of a prenuptial agreement signed in 2022.
The actor, best known for his role as Theodore Huxtable on the 1980s sitcom The Cosby Show, died at age 54 on July 20, 2025, following a drowning accident while vacationing in Costa Rica. Pamela Warner, who served as her son’s manager early in his career, is named in the filing as the successor trustee of the Warner family trust.
According to the legal documents, the couple married on May 23, 2022, having signed a prenuptial agreement on May 15 of that year. The lawsuit alleges that the actor failed to fulfill several financial obligations stipulated in that contract. Specifically, the filing claims he did not maintain a $1,000,000 term life insurance policy naming his wife as the beneficiary. Furthermore, the suit alleges he failed to make annual payments of $16,000, neglected to maintain a Roth Individual Retirement Account for her, and did not pay a promised $5,000 monthly salary for her work as his chief of staff.
The total amount sought by the plaintiff, including interest and legal fees, is at least $1,276,042.46. Tenisha Warner stated through her attorney that she spent the past year attempting to settle the estate privately to honor her husband’s wishes. She noted that her husband intended to update his estate plan—which she described as a stale document from 1996—to better provide for her and their young daughter, but he passed away before those changes could be finalized.
Reflecting on the challenges of the past year, Tenisha Warner remarked, “Sadly, he was unable to do so before we lost him. I have been struggling to care for our daughter as a single mom and now as her sole provider. Legally, I had no choice but to take action to protect our rights before any potential statute of limitations expired.”
The actor had maintained a private life for his wife and daughter while he was alive. In September 2025, his widow shared a tribute on social media, announcing that she and their daughter were launching a company in his honor. At that time, she wrote, “I can still hear my husband’s laugh, still feel the way he made room for every part of me — every tear, every dream.”
On the first anniversary of his death, Pamela Warner posted a message on the actor’s memorial Instagram account, expressing her grief over the loss. “It is the parent that leaves first and leaves the child/children to continue on with their lives. But what do you do when this is out of order and the child/children leave first?” she wrote. “This is where I found myself July 20, 2025. And this is what I awoke to July 20, 2026.
